Land Use Management

The department is currently advertising amendments to the City of Cape Town Municipal Planning By-Law, 2015 and calling on you to ‘Have your Say’. Comments close on 23 September 2024.

New public participation process – MPBL review

The City’s Development Management Department invites interested and affected resident to comment on the proposed amendments to the City of Cape Town Municipal Planning By-Law, 2015 (MPBL). The comment period opens today, Monday 22 July 2024 and closes on Monday, 23 September 2024.

In accordance with Section 27 of the by-law, the City Manager must review the Development Management Scheme (DMS) at least every five years. After following due process, the City has prepared proposed amendments to the MPBL and the DMS. The proposed amendments are extensive.

One of the proposals provides for the development of affordable rental flats as an additional use right in selected residential areas across the city. The 194 areas identified for this proposed additional use right are those where, typically, state-funded housing developments have been and are being implemented, and where the average household income is in the low- to mid-range.

The 194 target areas include:
Bellville, Beacon Valley, Belhar, Bishop Lavis, Brown’s Farms, Bloekombos, Crossroads, Delft, Dunoon, Enkanini, Fisantekraal, Grassy Park, Gugulethu, Heideveld, Joe Slovo Park, Kommetjie, Kraaifontein, Khayelitsha, Kuyasa, Langa, Lavender Hill, Lentegeur, Lwandle, Mamre, Nomzamo, Nyanga, Ocean View, Parow Valley, Pelican Park, Philippi, Phoenix, Retreat, Westlake, Muizenberg, Hout Bay, Sea Winds, Sir Lowry’s Pass, Strand, Strandfontein, Steenberg, Scottsdene, Saxonsea, Sun City, The Hague, Valhalla Park, Vrygrond, Wallacedene, Wetton, Witsand and Westridge in Mitchells Plain, among others.

The proposed amendments and new provisions to the Municipal Planning By-law are intended to also give effect to the spatial policies and strategies that the City Council has adopted since the last major revision in 2019.
